Pader district grade one magistrate's court on Thursday, 27th remanded a doctor working in Awere sub county to Kinene prison custody for performing an illegal abortion on a girl whose identity was withheld in Pader.
Toby Atubu, 29, a health worker in Atede central ward, Awere sub county in Pader pleaded not guilty and the court ordered him to re-appear on February 7th, 2022.
State prosecutor told the court presided over by Mr. Kirumba Atwooki that on January 22nd this year, the girl whose name has been withheld, informed her parents that she bought a tablet (medicine) from Atubu’s drug shop.
The prosecution said Atubu, who is now at large, gave the tablet to the girl to terminate the pregnancy.
Atubu while appearing before the Magistrate court requested for court bail as the constitution permits since he has the sureties (his mother age 60 and a brother from Lira city) to stand for him.
However, the state prosecutor objected to the bail request made by the accused since the sureties presented before the court were substandard with inadequate documents. He added that the accused may not report to court since all the sureties are from different districts.
Mr. Atwooki in his ruling stated that the accused person cannot be granted bail because his sureties have got a number of issues including advance in age, and might not be able to report to court. he further remanded Atubu to Kinene prison with hearing date on 7th February 2022.
